BACKGROUND:

 

Tort claims against the state historically were satisfied from a general tort claim revolving fund.  In an effort to achieve more efficient risk management and accountability of individual agencies, the liability revolving fund was established in 1989 at which time the tort claim revolving fund was abolished.  Agencies contribute to the liability revolving fund in proportion to the claims they are responsible for.  The Governor's Risk Management Advisory Committee recommends that the tort claim revolving fund be reauthorized for the limited purpose of satisfying claims arising from conduct which occurred prior to July 1, 1990.

 

SUMMARY:

 

A tort claims revolving fund is reestablished for the purpose of paying tort claims against the state which arise from conduct taking place prior to July 1, 1990.
