                              SYNOPSIS AS ENACTED

 

 

Brief Description:  Making technical corrections to provisions for the state militia.

BACKGROUND:

 

In 1989, the Legislature revised the statutes relating to state military affairs.  Subsequent review by the Military Department and the Code Reviser revealed a number of editorial errors which the department seeks to correct.

 

The only substantive provision deals with penalties which may be imposed under the code of military justice.  If the penalty imposed requires extra duty hours, the statute still refers to "forfeiture," implying a sum of money.  The term should be "restriction" (to the duty station).

 

SUMMARY:

 

Numerous editorial changes are made to the statutes relating to state military affairs, for clarity and modern military usage.

 

In the section dealing with mitigation of punishment, "restriction" may not be longer than the number of hours of extra duty that may have been imposed.
