BACKGROUND:
Chapter 36.87 RCW provides guidelines for counties to vacate or abandon all or portions of county roads. A specific portion of those guidelines prohibit a county from vacating a county road which abuts on a body of salt or fresh water unless the property is zoned for industrial uses or the purpose of the vacation is to enable a public authority to acquire the vacated property for port purposes, boat moorage, launching sites or for park, viewpoint, recreational, educational, or other public purposes.
SUMMARY:
When counties vacate portions of county roads that abut salt or fresh water they may, in addition to the other public purposes already provided, sell the property to the party from which it was originally obtained by the county.
