BACKGROUND:

 

In 1991 legislation was passed requiring a person guiding people to fish for salmon to be licensed as a professional salmon guide.  The Department of Fisheries was authorized to issue the license.  However, the department has interpreted the statute to license vessels and not persons as specified in the act. 

 

SUMMARY:

 

For the purposes of operating as a guide for salmon for personal use in fresh water rivers and streams, a person shall be licensed as a professional salmon guide.  The department will issue professional salmon guide licenses to natural persons and not to vessels.  As used in the law, the term "holder" means a natural person and not a vessel.
