BACKGROUND:

 

In 1989, legislation was enacted to provide local governments greater flexibility to procure solid waste facilities and services.  Included in the legislation was a limitation on the use of the alternative selection process when local government is selecting contractors for construction of certain solid waste handling facilities.  However, that limitation was incorrectly added to provisions of law relating to establishment of systems of solid waste handling, rather than to the laws governing local government selection of vendors for construction of solid waste facilities.

 

In 1991, comprehensive legislation addressing recycling and the development of markets for recyclable materials was enacted.  Several technical revisions to the legislation have been recommended.

 

SUMMARY:

 

Provisions relating to a limitation on local government selection of solid waste facility vendors are moved to the correct sections of law addressing this subject.  Grammatical changes are made to provisions of the 1991 recycling legislation.  A correction to the legislation on reduction of heavy metals in product packaging is made to clarify that the limitations do not apply to the products within the packaging.
