Read first time January 29, 1991.  Requiring that criminal penalties set by cities and counties be the same as those set in state law.


     AN ACT Relating to uniform criminal penalties; adding a new section to chapter 35.21 RCW; adding a new section to chapter 36.01 RCW; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 35.21 RCW to read as follows:

     Except as limited by the maximum penalty authorized by law, no city, code city, or town, may establish a penalty for an act that constitutes a crime under state law that is less than the penalty prescribed for that crime by state statute.

 

     NEW SECTION.  Sec. 2.  A new section is added to chapter 36.01 RCW to read as follows:

     Except as limited by the maximum penalty authorized by law, no county may establish a penalty for an act that constitutes a crime under state law that is less than the penalty prescribed for that crime by state statute.

 

     NEW SECTION.  Sec. 3.      This act shall take effect July 1, 1992.
