Read first time January 31, 1991.  Referred to Committee on Local Government.Specifying the authority of a city or town to adopt land use controls for land used for airport runways.


     AN ACT Relating to port districts; adding a new section to chapter 14.07 RCW; adding a new section to chapter 14.08 RCW; adding a new section to chapter 14.12 RCW; and adding a new section to chapter 53.08 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 14.07 RCW to read as follows:

     The initial use of land located in a city or town by a port district for airport runway purposes, and the expansion of an existing airport runway located in the city or town by a port district, are subject to potential land use controls by the city or town.  The initial use of land located in the unincorporated area of a county by a port district for airport runway purposes, and the expansion of an existing airport runway located in the unincorporated area of a county, are subject to potential land use controls by the county.  Once an airport runway has been established pursuant to the county's, city's, or town's land use controls, the county, city, or town may not adopt new limitations on or prohibit such use for the land unless the land is not in actual use as an airport runway for a continuous five-year period.
