AN ACT Relating to paternity actions; adding a new section to chapter 26.26 RCW; and adding a new section to chapter 74.12 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 26.26 RCW to read as follows:
(1) The statute of limitations for a mother to initiate a paternity action for the purposes of collecting back child support or childbirth expenses is six months.
(2) The statute of limitations for the department to initiate paternity actions for the purposes of assessing and collecting retroactive child support and childbirth expenses is three months from the time the department establishes the child's eligibility for public assistance.
(3) The statute of limitations for the department to initiate paternity actions for the purposes of assessing prospective child support payments is six months from the time the department is notified of the name of the reputed father.
(4) "Childbirth expenses" as used in this section means medical expenses incurred in the prenatal care and birth of the child.
