AN ACT Relating to the siting of hazardous waste incinerators near agricultural lands; and adding a new section to chapter 70.105 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 70.105 RCW to read as follows:
The department shall not issue a permit for the siting and operation of a facility for the incineration of hazardous wastes if agricultural lands, as defined in RCW 84.34.020, from which more than fifty percent of a person's income is derived from farming activities lie within a five-mile radius of the facility site.
NEW SECTION. Sec. 2. If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
