AN ACT Relating to the siting of portable school buildings by school districts; adding a new section to chapter 28A.335 RCW; adding a new section to chapter 35.22 RCW; adding a new section to chapter 35.63 RCW; adding a new section to chapter 35A.63 RCW; adding a new section to chapter 36.32 RCW; and adding a new section to chapter 36.70 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 28A.335 RCW to read as follows:
A school district board of directors, by a two-thirds vote of the entire board, may adopt a resolution declaring an overcrowding emergency to exist and may site or construct portable school classrooms and other portable school facilities on school district property in violation of county, city, or town zoning or other land use controls. A resolution declaring such an emergency shall remain in effect for no longer than one hundred eighty days. Once the portable facilities are sited or constructed they may remain in place, notwithstanding county, city, or town zoning or other land use controls.
NEW SECTION. Sec. 2. A new section is added to chapter 35.22 RCW to read as follows:
Zoning and other land use controls adopted by a first class city under the authority of its charter are subject to section 1 of this act.
NEW SECTION. Sec. 3. A new section is added to chapter 35.63 RCW to read as follows:
County, city, and town zoning and other land use controls are subject to section 1 of this act.
NEW SECTION. Sec. 4. A new section is added to chapter 35A.63 RCW to read as follows:
Code city zoning and other land use controls are subject to section 1 of this act.
NEW SECTION. Sec. 5. A new section is added to chapter 36.32 RCW to read as follows:
Zoning and other land use controls adopted by a charter county under the authority of its charter are subject to section 1 of this act.
NEW SECTION. Sec. 6. A new section is added to chapter 36.70 RCW to read as follows:
County zoning and other land use controls are subject to section 1 of this act.
