     AN ACT Relating to payment for earned vacation time; and adding a new section to chapter 49.48 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 49.48 RCW to read as follows:

     (1) If a contract of employment or employment policy provides for paid vacations, and an employee is separated from his or her employment by resignation, discharge, or otherwise, without having taken all the vacation time earned under the contract or policy, the monetary equivalent of the earned vacation that was untaken shall be paid to the employee as part of the employee's final compensation at his or her final rate of pay.  However, an applicable collective bargaining agreement may provide for another method of paying for earned vacation.  An employment contract or employment policy providing for forfeiture or waiver of earned vacation time upon separation from employment is void as against public policy.

     (2) This section applies to all separations from employment that begin on or after the effective date of this act.
