     AN ACT Relating to compensating a landowner whose bona fide rights were impaired by a department of natural resources resurvey; and adding a new section to chapter 58.24 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 58.24 RCW to read as follows:

     If a landowner challenges a resurvey and through arbitration or mediation with the department of natural resources it is determined that the landowner's bona fide rights were negatively affected, the department of natural resources shall compensate the landowner for those impaired rights.  The landowner may challenge a resurvey in the superior court with jurisdiction over the land parcel.  If the landowner is successful, the department of natural resources shall pay any judgment ordered by the court plus all reasonable court fees and costs, including attorneys' fees.
