AN ACT Relating to payment of fees for hazardous substances incineration facilities; adding a new section to chapter 70.105 RCW; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 70.105 RCW to read as follows:
(1) The department shall impose on the owner or operator of a hazardous waste incinerator a fee on hazardous waste received at the facility destined for incineration. The fee shall be determined as provided in subsection (2) of this section. The fee shall be assessed, collected, and disbursed monthly.
(2)(a) If a hazardous waste incinerator is located in a county in which a low-level radioactive waste facility is located, the fee provided for in subsection (1) of this section shall be thirty-five dollars per ton of hazardous waste destined for incineration at the facility. The fee shall be deposited in the economic investment fund established by the legislature for that county.
(b) If a hazardous waste incinerator is not located in a county in which a low-level radioactive waste facility is located, the fee provided for in subsection (1) of this section shall be thirty-five dollars per ton of waste destined for incineration at the facility or an equivalent fee amount after considering other payments made by the applicant in lieu of the fee. The amount of the fee shall be determined through the citizen proponent negotiation process provided for in RCW 70.105.260.
NEW SECTION. Sec. 2. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
