     AN ACT Relating to prohibiting the duplication of mitigation for the same system improvements; and adding a new section to chapter 82.02 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 82.02 RCW to read as follows:

     The requirements under RCW 36.70A.060 include both:  (1) Provision of a credit on impact fees imposed under this chapter for the value of improvements made by the developer on the same system improvements for the  same development activity as the result of an environmental review under chapter 43.21C RCW; and (2) consideration of studies made under chapter 43.21C RCW for impacts arising from the same development activity.

     The impact fees imposed on development activity under this chapter for a system improvement shall be considered in any environmental review under chapter 43.21C RCW for the impact of the same development activity on the same system improvements.
