     AN ACT Relating to contractor registration requirements; adding a new section to chapter 18.27 RCW; adding a new section to chapter 19.28 RCW; adding a new section to chapter 18.106 RCW; creating a new section; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 18.27 RCW to read as follows:

     (1) Every applicant registering as a contractor under this chapter for the first time shall be required to attend an educational seminar on laws applicable to the business of contracting in the state of Washington.  The seminar shall be presented by the department of revenue and shall emphasize the state tax reporting requirements.  Where practical, the seminar shall include presentations by other state agencies and may be cosponsored by the contractors' organizations.

     (2) Every applicant renewing a registration under this chapter shall be required to attend an educational seminar as provided in subsection (1) of this section at least once every four years.

     (3) The department of revenue shall certify the attendance of each contractor to the department of labor and industries.

     (4) The failure of a contractor to attend a seminar under subsection (1) of this section within six months of his or her initial registration shall be grounds for revocation of that contractor's registration.

     (5) The failure of a contractor renewing his or her registration to attend a seminar as required in subsection (2) of this section at least once every four years shall be grounds for revocation of that contractor's registration.

     (6) The department of revenue is authorized to require the attendance of any contractor with a demonstrated compliance problem at a seminar as provided in subsection (1) of this section at the first available time and place once the problem has been discovered.

 

     NEW SECTION.  Sec. 2.  A new section is added to chapter 19.28 RCW to read as follows:

     (1) Every applicant receiving a license as an electrical contractor under this chapter for the first time shall be required to attend an educational seminar on laws applicable to the business of contracting in the state of Washington.  The seminar shall be presented by the department of revenue and shall emphasize the state tax reporting requirements.  Where practical, the seminar shall include presentations by other state agencies and may be cosponsored by the electrical contractors' organizations.

     (2) Every applicant renewing a license under this chapter shall be required to attend an educational seminar as provided in subsection (1) of this section at least once every four years.

     (3) The department of revenue shall certify the attendance of each electrical contractor to the department of labor and industries.

     (4) The failure of an electrical contractor to attend a seminar under subsection (1) of this section within six months of his or her initial registration shall be grounds for revocation of that contractor's registration.

     (5) The failure of an electrical contractor renewing his or her registration to attend a seminar at least once every four years as required in subsection (2) of this section shall be grounds for revocation of that contractor's registration.

     (6) The department of revenue is authorized to require the attendance of any electrical contractor with a demonstrated compliance problem at a seminar as provided in subsection (1) of this section at the first available time and place once a problem has been discovered.

 

     NEW SECTION.  Sec. 3.  A new section is added to chapter 18.106 RCW to read as follows:

     (1) Every applicant receiving a certificate of competency as a plumber contractor under this chapter for the first time shall be required to attend an educational seminar on laws applicable to the business of contracting in the state of Washington.  The seminar shall be presented by the department of revenue and shall emphasize the state tax reporting requirements.  Where practical, the seminar shall include presentations by other state agencies and may be cosponsored by the plumbers' organizations.

     (2) Every applicant renewing a certificate under this chapter shall be required to attend an educational seminar as provided in subsection (1) of this section at least once every four years.

     (3) The department of revenue shall certify the attendance of each plumber contractor to the department of labor and industries.

     (4) The failure of a plumber to attend a seminar under subsection (1) of this section within six months of his or her initial certification shall be grounds for revocation of that plumber's certification.

     (5) The failure of a plumber renewing his or her certification to attend a seminar as required in subsection (2) of this section at least once every four years shall be grounds for revocation of that plumber's certification.

     (6) The department of revenue is authorized to require the attendance of any plumber with a demonstrated compliance problem at a seminar as provided in subsection (1) of this section at the first available time and place once the problem has been discovered.

 

     NEW SECTION.  Sec. 4.      The department of revenue shall conduct a study of compliance with the excise tax laws within the construction industry.  The study shall place special emphasis on the causes or reasons for noncompliance.  The department shall report the findings of the study to committees of the legislature that deal with contractors and revenue no later than January 6, 1994.

 

     NEW SECTION.  Sec. 5.      This act shall take effect July 1, 1992.
