     AN ACT Relating to institutional trust lands; adding a new section to chapter 43.30 RCW; adding a new section to chapter 79.08 RCW; creating a new section; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  The purpose of this act is to maximize the return to Thurston county beneficiaries of institutional trust lands, lands held in trust for state charitable, educational, penal, and reformatory institutions.

 

     NEW SECTION.  Sec. 2.  A new section is added to chapter 43.30 RCW to read as follows:

     The board of natural resources shall implement a management plan for the institutional trust lands located in Thurston county that allows direct use of these lands by persons who are mentally ill or developmentally disabled, as authorized by section 3 of this act.  "Direct use" includes use of the land for housing.  Use of these trust lands rent free for housing of persons who are mentally ill or developmentally disabled is deemed to be the highest and best use of the land and shall be an element of the management plan.  The board shall adopt rules under chapter 34.05 RCW to implement this section.

 

     NEW SECTION.  Sec. 3.  A new section is added to chapter 79.08 RCW to read as follows:

     The board of natural resources may manage institutional lands, as defined in RCW 79.01.004, for the direct use and benefit of the trust land beneficiaries.  The board may authorize the rent-free use of these lands.

 

     NEW SECTION.  Sec. 4.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
