     AN ACT Relating to the removal of presidents of state institutions of higher education for misrepresentation; and adding new sections to chapter 28B.10 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.      For the purposes of sections 2 and 3 of this act, the following definition applies:  "Misrepresentation" or "misrepresented" includes any manifestation by words or other conduct to the board of regents or trustees of a state institution of higher education, or the delegates or representatives of such a board, that amounts to an assertion not in accordance with the facts.

 

     NEW SECTION.  Sec. 2.      The contract of employment for any president of a state institution of higher education shall include the provision that the board of regents or trustees of the state institution of higher education have the full authority and responsibility to remove, without any manner of compensation or contractual buyout, the president of the institution should the board find that the individual misrepresented himself or herself in any manner during the application, appointment, or hiring process.

 

     NEW SECTION.  Sec. 3.      Nothing contained in section 2 of this act shall be construed to alter any existing contract or the provisions of any existing contract.  Section 2 of this act shall not apply to any college or university president hired before the effective date of this act.

 

     NEW SECTION.  Sec. 4.      Sections 1 through 3 of this act are each added to chapter 28B.10 RCW.

 

     NEW SECTION.  Sec. 5.      If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
