AN ACT Relating to penalties for underenrollment in institutions of higher education and branch campuses; adding a new section to chapter 28B.10 RCW; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 28B.10 RCW to read as follows:
(1) Each state institution of higher education, and each branch campus of a state institution specifically established in chapter 28B.45 RCW, that is appropriated or allocated state funds for the purpose of providing educational services for a specific full-time equivalent enrollment level, as authorized by the omnibus appropriations act, is required to provide such services at the specified full-time equivalent enrollment level within a margin of two percent of the authorized level.
(2) If any state institution of higher education, or any statutorily authorized branch campus of such state institution, provides, in each academic year, educational services to a full-time equivalent enrollment level that is more than two percent below the amount authorized by the omnibus appropriations act, a portion of its state funding allocation or appropriation shall revert, by July 1 following the academic year in question, to the state general fund in an amount equal to the full average state-funded appropriation per full-time equivalent enrollment that is below the two percent limitation.
(3) The office of financial management shall monitor the state-funded enrollment level of each state institution of higher education and each branch campus of such institution to ensure compliance with this section. The office of financial management may take action to withhold appropriate portions of succeeding allotments of state funds to an institution should it determine that any reversions of state funds required under this section have not been made by the institution.
NEW SECTION. Sec. 2. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
