AN ACT Relating to industrial insurance disability payments subject to collection by the office of support enforcement; and amending RCW 74.20A.260.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. RCW 74.20A.260 and 1987 c 435 s 34 are each amended to read as follows:
Disability payments made pursuant to Title 51 RCW shall be classified as earnings and shall be subject to collection action by the office for support enforcement under this chapter and all other applicable state statutes. The amount subject to collection by the office of support enforcement shall bear its proportionate share of attorneys' fees and costs, if any, incurred by the injured worker or worker's dependent in obtaining disability payments.
