AN ACT Relating to compacts negotiated under the Indian Gaming Regulatory Act of 1988; adding new sections to chapter 9.46 RCW; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 9.46 RCW to read as follows:
The joint legislative committee on Indian gaming compacts is created to review compacts negotiated under the Indian Gaming Regulatory Act, P.L. 100-497. The committee consists of the majority and the minority leaders of the house of representatives, the majority and the minority leaders of the senate, and two members from each caucus in the house and the senate, appointed by the caucus leaders, all of whom shall be voting members. The committee shall elect a member from the senate and a member from the house of representatives as cochairs.
NEW SECTION. Sec. 2. A new section is added to chapter 9.46 RCW to read as follows:
(1) Upon request of an Indian tribe as defined in P.L. 100-497, the gambling commission shall designate a negotiating team to implement P.L. 100-497, Sec.11(d)(3)(A) by negotiating with the tribe for the purpose of entering into a tribal-state compact. The commission shall be advised by the attorney general's office and shall consult with the governor, the state patrol, the lottery commission, the horse racing commission, and interested local governments during the course of negotiations.
(2) The commission shall conduct at least one public hearing and provide an opportunity for public comment on any proposed compact. Upon completion of the public hearing process and upon a majority vote of all of its members, the commission shall by single resolution either remand the proposal for further negotiations, or approve the proposal. If approved, the commission shall immediately forward the compact to the cochairs of the joint legislative committee on Indian gaming.
(3) Within thirty days of receipt of a compact from the gambling commission, the joint legislative committee on Indian gaming shall by majority vote of all of its members either (a) approve of the compact or (b) take action to submit the compact to the full legislature for consideration. If approved, the compact is effective the thirtieth day after approval. If the compact is rejected it shall be remanded to the commission for further negotiation. The resolution of remand shall set forth the specific issue that warrant further negotiation.
NEW SECTION. Sec. 3. This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
