     AN ACT Relating to commercial salmon licenses; amending RCW 75.28.035 and 75.28.040; adding new sections to Title 75 RCW; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     Sec. 1.  RCW 75.28.035 and 1989 c 316 s 1 are each amended to read as follows:

     An application for issuance or renewal of a commercial fishing license shall contain the name and address of the vessel owner, the name and address of the vessel operator, the name and number of the vessel, a description of the vessel and fishing gear to be carried on the vessel, and other information required by the department.

     At the time of issuance of a commercial fishing license the director shall furnish the licensee with a vessel registration and two license decals.

     Vessel registrations and license decals issued by the director shall be displayed as provided by rule of the director.

     A commercial fishing license is not valid if the vessel is operated by a person other than the operator listed on the license.  ((The director may authorize additional operators for the license.  Unless adjusted by the director pursuant to the director's authority granted in RCW 75.28.065, the fee for an additional operator is twenty dollars.

     The vessel owner shall notify the director on forms provided by the department of changes of ownership or operator and a new license shall be issued upon payment of a fee of twenty dollars.))

      A  defaced, mutilated, or lost license or license decal shall be replaced immediately.  Unless adjusted by the director pursuant to the director's authority granted in RCW 75.28.065, the replacement fee is ten dollars.

 

     Sec. 2.  RCW 75.28.040 and 1983 1st ex.s. c 46 s 108 are each amended to read as follows:

     Commercial licenses and permits expire at midnight on December 31st following their issuance and in accordance with this title may be renewed annually upon application and payment of the prescribed license fees and meeting the one thousand pound salmon landing requirement for salmon licenses.

 

     NEW SECTION.  Sec. 3.      In order to renew a commercial salmon fishing license a licensee must have landed one thousand pounds of salmon in a Washington state fishery in the immediately previous calendar year.  Department fish tickets shall be required documentation for this requirement.

 

     NEW SECTION.  Sec. 4.      Commercial salmon licenses may be transferred to other persons only if the transferee is a spouse or child of the transferor and the transferee has landed one thousand pounds of salmon in a Washington state fishery the previous calendar year.

 

     NEW SECTION.  Sec. 5.      Commercial salmon licensees are the only persons who may fish with a commercial fishing vessel in a commercial salmon fishery.  Additional operators are not authorized.

 

     NEW SECTION.  Sec. 6.      A person may not be licensed with more than one commercial salmon fishing license at a time.

 

     NEW SECTION.  Sec. 7.      The director shall issue a maximum of one hundred eighty charter boat salmon licenses.  The director shall establish a lottery selection process for calendar year 1993 charter boat salmon licenses.  Only valid 1992 salmon charter boat licenses shall be eligible for inclusion in the lottery selection.  No salmon landing requirement is required in order to renew salmon charter boat licenses.

 

     NEW SECTION.  Sec. 8.      Sections 3 through 7 of this act are each added to Title 75 RCW.

 

     NEW SECTION.  Sec. 9.      If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.

 

     NEW SECTION.  Sec. 10.     This act shall take effect January 1, 1993.
