     AN ACT Relating to the modification of the clean air act to provide for the testing of marine vessels; amending RCW 70.94.040; and adding a new section to chapter 70.94 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 70.94 RCW to read as follows:

     Emissions caused by the testing of repaired marine vessel engines shall be exempted from the provisions of RCW 70.94.040.

     Sec. 2.  RCW 70.94.040 and 1980 c 175 s 2 are each amended to read as follows:

     Except where specified in a variance permit((, as provided in)) issued under RCW 70.94.181, or as otherwise provided for in this chapter, it shall be unlawful for any person to cause air pollution or permit it to be caused in violation of this chapter, or of any ordinance, resolution, rule or regulation validly promulgated hereunder.
