                         SENATE CONCURRENT RESOLUTION 8416

Read first time June 11, 1991.  Referred to Committee on Law & Justice. Resolving to create the Washington Condominium Task Force.


     WHEREAS, The Washington Condominium Task Force was created by the Legislature in 1987 to review existing legislation governing the creation of condominiums; and

     WHEREAS, The Washington Condominium Task Force consisted of representatives from condominium associations, developers, mortgage bankers, title companies, realtors, consumers, attorneys, and county assessors; and

     WHEREAS, The Washington Condominium Task Force undertook the herculean task of attempting to accommodate the varying and often competing concerns of numerous interest groups without financial remuneration; and

     WHEREAS, The Washington Condominium Task Force drafted the Washington Condominium Act to address deficiencies in existing condominium statutes; and

     WHEREAS, The Washington Condominium Act was enacted in 1989 and became effective on July 1, 1990; and

     WHEREAS, The Washington Condominium Act is a comprehensive and extensive new statute governing the development, management, and ownership of condominiums; and

     WHEREAS, The enactment of the Washington Condominium Act represents the culmination of a long, arduous, and painstaking process that began well over ten years ago; and

     WHEREAS, The Washington Condominium Task Force has provided an invaluable service to the legislative process by drafting the Washington Condominium Act and preparing Official Comments thereto; and

     WHEREAS, The Washington Condominium Task Force officially ceased to exist on March 1, 1990;

     NOW, THEREFORE, BE IT RESOLVED, By the Senate of the state of Washington, the House of Representatives concurring, that the Washington Condominium Task Force be recreated to:  (1) Review the Washington Condominium Act; (2) draft recommended revisions to the act; (3) prepare appropriate revisions to the Official Comments to the Washington Condominium Act; and

     BE IT FURTHER RESOLVED, That the Washington Condominium Task Force consist of the following members:

     (1) One member each of the majority and minority parties of the senate, appointed by the president of the senate;

     (2) One member each of the majority and minority parties of the house of representatives, appointed by the speaker of the house of representatives;

     (3) Four members of the Washington Condominium Act revision committee of the Washington state bar association;

     (4) One member appointed by the Washington land title association;

     (5) One member appointed by the Washington mortgage bankers association;

     (6) One member appointed by the Washington association of realtors;

     (7) One member appointed by the Washington chapter of the community associations institute;

     (8) One member appointed by the homebuilders association of Washington state;

     (9) One member appointed by the Washington association of county officials; and

     (10) One member appointed by the institute for real estate management who has lived in a condominium for at least the last five years prior to the appointment and who has served on a condominium association board; and

     BE IT FURTHER RESOLVED, That the Washington Condominium Task Force shall report its recommendations to the Senate law and justice committee and the House of Representatives judiciary committee by March 1, 1992.
