     On page 44, line 33, after "Sec. 310." strike all material through line 7 on page 47 and insert:  "REFERENDUM ON IMPASSE.  When parties have been engaged in collective bargaining under this chapter and, in the opinion of the state employment relations commission, have reached an impasse, the commission shall proclaim an impasse to exist and request the exclusive bargaining representative and the employer to submit their final best offers.  If within twenty-four hours of the time when the last party has submitted its offer, the parties have failed to reach an agreement, then the commission, if requested by the exclusive bargaining representative, shall submit the offer of the exclusive bargaining agent to the secretary of state for submission to the voters.  At the next general election, or sooner if provided for by the legislature, the secretary of state shall provide for referring such offer to the voters. If the voters approve the offer, then it shall constitute a collective bargaining agreement under this chapter, with compensations provisions effective retroactive to the date of the impasse.  If the voters do not approve the offer, then the employer's offer shall constitute a collective bargaining agreement under this chapter, with compensation provisions effective retroactive to the date of the impasse.  The commission may delegate to the director any of its responsibilities under this section."


 

 

EFFECT:  Deletes interest arbitration provisions.  Provides for a referendum on exclusive bargaining representative's last offer when there is an impasse and the exclusive bargaining representative requests the referendum.  If approved by voters, the offer will be considered as a collective bargaining agreement.  If the offer is rejected by the voters, then the employer's last offer will be considered as a collective bargaining agreement.
