     On page 2, beginning on line 1, strike all of section 101 and insert the following:

     "NEW SECTION.  Sec. 101.  This act shall be known and may be cited as the privatization and contracting-out of government services and the civil service and collective bargaining reform act."

 

     On page 2, line 3, after "(1)" insert the following:

     "The legislature finds that there are many facilities, programs and services designed, constructed, or operated by state and local governments that could be designed, constructed, or operated by nongovernmental entities more efficiently and at lower cost, and that excessive costs incurred under current policies, including restraints on competitive bidding that artificially increase costs, put an unnecessary and avoidable strain on the budgets of state and local governments and the taxpayers.  The legislature also finds that legal and practical constraints on revenues and budgets require innovative approaches in order to eliminate excessive costs and that the private sector has the willingness and the capability to provide facilities, programs and services to state and local governments at a substantial savings over what these governments are currently spending in providing facilities, programs and services."

 

     On page 2, line 13, after "(2)" insert the following:

     "It is the purpose of this act to allow a unit of government to contract with the private sector to design, construct, or operate facilities, programs, or services and to eliminate restraints on competitive bidding that artificially increase costs in order to ensure taxpayers receive cost-effective, efficient government and that government does not compete unfairly or unnecessarily with the private sector."

 

     On page 13, beginning on line 4, strike all of section 207.

 

     Renumber the remaining sections consecutively and correct internal references accordingly.


 

 

 

 

EFFECT:  Strengthens contracting out language in the intent section and deletes from the bill the provisions regarding contracting out.
