     On page 15, after line 9 of the amendment, insert the following:

     "NEW SECTION.  Sec. 17.  A new section is added to chapter 35.63 RCW to read as follows:

     No city may enact or maintain an ordinance, development regulation, zoning regulation or official control, policy, or administrative practice which treats the siting of a structure or housing unit occupied by persons with handicaps differently than a structure or housing unit occupied by similar sized groups of unrelated individuals.  As used in this section, "handicaps" are as defined in the federal fair housing amendments act of 1988 (42 U.S.C. Sec. 3602).

 

     NEW SECTION.  Sec. 18.  A new section is added to chapter 35A.63 RCW to read as follows:

     No city may enact or maintain an ordinance, development regulation, zoning regulation or official control, policy, or administrative practice which treats the siting of a structure or housing unit occupied by persons with handicaps differently than a structure or housing unit occupied by similar sized groups of unrelated individuals.  As used in this section, "handicaps" are as defined in the federal fair housing amendments act of 1988 (42 U.S.C. Sec. 3602).

     No county may enact or maintain an ordinance, development regulation, zoning regulation or official control, policy, or administrative practice which treats the siting of a structure or housing unit occupied by persons with handicaps differently than a structure or housing unit occupied by similar sized groups of unrelated individuals.  As used in this section, "handicaps" are as defined in the federal fair housing amendments act of 1988 (42 U.S.C. Sec. 3602).

 

     NEW SECTION.  Sec. 20.  A new section is added to chapter 36.70A RCW to read as follows:

     No county or city that plans or elects to plan under this chapter may enact or maintain an ordinance, development regulation, zoning regulation or official control, policy, or administrative practice which treats the siting of a structure or housing unit occupied by persons with handicaps differently than a structure or housing unit occupied by similar groups sized groups of unrelated individuals.  As used in this section, "handicaps" are as defined in the federal fair housing amendments act of 1988 (42 U.S.C. Sec. 3602)."

 

     Renumber the remaining sections consecutively and correct internal references accordingly.

 


 

 

 

 

 

 

EFFECT:  Prohibits local governments from imposing siting requirements on housing for persons with handicaps that are different from siting requirements for housing that is for unrelated individuals that is of similar sized occupancy.
