    On page 18, after line 2 of the amendment, insert the following:

 

    "NEW SECTION.  Sec. 113.  A new section is added to chapter 82.08 RCW to read as follows:

    The tax levied by RCW 82.08.020 shall not apply to sales of watercraft, sales of component parts thereof, or sales of oil spill removal equipment, to a nonprofit entity exempt from federal income tax under section 501(c)(4) of the Internal Revenue Code of 1986, for the primary purpose of use in the removal of oil from navigable waters of the state or for training in such use.  As used in this section, "oil" and "navigable waters of the state" have the meaning given to them in RCW 90.56.010; "equipment" includes, without limitation, booms, skimmers, power packs, and other equipment necessary or useful to oil spill removal operations; and "removal" means containment and removal of oil or the taking of other actions as may be necessary to minimize or mitigate oil spill damage to the public health or welfare including but not limited to fish, shellfish, wildlife, and public and private property, shorelines, and beaches.

 

    NEW SECTION.  Sec. 114.  A new section is added to chapter 82.12 RCW to read as follows:

    The provisions of this chapter shall not apply in respect to the use of watercraft, the use of component parts thereof, or the use of oil spill removal equipment, by a nonprofit entity exempt from federal income tax under section 501(c)(4) of the Internal Revenue Code of 1986, for the primary purpose of removal of oil from navigable waters of the state, including training in such removal.  As used in this section, "oil" and "navigable waters of the state" have the meaning given to them in RCW 90.56.010; "equipment" includes, without limitation, booms, skimmers, power packs, and other equipment necessary or useful to oil spill removal operations; and "removal" means containment and removal of oil or the taking of other actions as may be necessary to minimize or mitigate oil spill damage to the public health or welfare including but not limited to fish, shellfish, wildlife, and public and private property, shorelines, and beaches.

 

    NEW SECTION.  Sec. 115.  Sections 113 and 114 of this act shall apply to watercraft, component parts, and equipment sold or first used in this state on or after March 1, 1993, and shall not apply to watercraft, component parts, and equipment sold or first used in this state after December 31, 1993."

 

    Renumber the remaining sections consecutively and correct any internal references accordingly.
