BACKGROUND:

 

The Sentencing Guidelines Commission was created by the Legislature to develop recommended standard sentence ranges for all felonies.  The original membership of the commission included the chair of the Indeterminate Sentence Review Board (ISRB) until July 1, 1992, when the board was scheduled to terminate.  After that date, the position was to be filled by the chair of the Clemency and Pardons Board.  Subsequently, the Legislature extended the termination date of the ISRB to June 30, 1998.  The commission recommends that the chair of the Indeterminate Sentence Review Board remain a member until expiration of the board in June 30, 1998. 

 

SUMMARY:

 

The chair of the Indeterminate Sentence Review Board remains an ex-officio member of the Sentencing Guidelines Commission until June 30, 1998.  The total membership of the commission is corrected from 15 to 16 members to reflect the membership of the chairs of both the Indeterminate Sentence Review Board and the Clemency and Pardons Board.

Effective Date:   The bill contains an emergency clause and takes effect immediately.

 

TESTIMONY FOR:

 

The bill allows the Chair of the Indeterminate Sentence Review Board to continue as a member of the Sentencing Guidelines Commission until the board expires in 1998.  This provides for continuity between the old sentencing laws and the Sentencing Reform Act.
