BACKGROUND:

 

The crime of "stalking" was established by statute during the 1992 legislative session.  It is not currently referenced in the juvenile sentencing schedule. 

 

The definition of a "minor or first offender" is complex and has created some uncertainty in juvenile courts.

 

SUMMARY:

 

The crimes of stalking, with no prior stalking offenses and stalking, with prior stalking offenses, are added to the juvenile disposition sentencing schedule. 

 

The definition of "minor or first offender" is clarified and simplified by describing the offenses that are included in the definition of minor or first offender as a category rather than listing them individually.
