BACKGROUND:
The Growth Management Act authorizes cities, counties and towns which develop comprehensive plans under that act to impose impact fees on development activity as part of the financing for public facilities related to that development. Impact fees may be collected and spent only on public facilities which are addressed by a capital facilities plan element of that agency's comprehensive plan. Public facilities means the following government owned or operated capital facilities: public streets and roads; publicly owned parks, open space, and recreation facilities; school facilities; and fire protection facilities in jurisdictions that are not part of a fire district.
SUMMARY:
The use of impact fees is expanded to also include traffic management and traffic programs addressed in the capital facilities plan element of local comprehensive plans.
