BACKGROUND:

 

States are permitted by federal law to disregard a certain amount of child support when determining food stamp need and eligibility.  When eligibility is calculated without including child support payments, more persons become eligible for food stamps.  The state is liable for the cost of the additional food stamps.

 

SUMMARY:

 

Child support payments are excluded, to the extent permitted by federal statute, in determining food stamp eligibility.
