BACKGROUND:

 

Federal law limits Aid to Families with Dependent Children (AFDC) payments to qualified children living with a parent or a relative of specified degree of kinship.

 

The term "guardian" in current Washington State statute has been interpreted to mean a child could receive AFDC if living with a "guardian."  This conflicts with federal law and has resulted in litigation and confusion.

 

SUMMARY:

 

The term "guardian" is deleted, clarifying that a child receiving AFDC must live with a parent or relative of specified degree.
