BACKGROUND:

 

Currently health care service contractors and health maintenance organizations file their forms and rates and use them without prior affirmative approval from the Insurance Commissioner.   

 

There is some concern that health care service contractors and health maintenance organizations should have their forms and rates approved affirmatively before use.  

 

SUMMARY:

 

Forms and rates for health care service contractors and health maintenance organizations are filed and cannot be used until affirmatively approved by the Insurance Commissioner.  Forms and rates not affirmatively approved within 60 days are deemed approved.  The commissioner may extend the approval period for 15 additional days upon giving notice to the insurer before the 60-day approval period expires.
