Establishing mandatory fines for persons convicted of drunk driving while transporting minors.


          AN ACT Relating to penalties for driving under the influence of liquor or drugs; adding a new section to chapter 46.61 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 46.61 RCW to read as follows:

          A person who is convicted of a violation of RCW 46.61.502 or 46.61.504 is subject to a mandatory minimum fine of five hundred dollars and a mandatory five days of community service in a program benefiting children if the person committed the violation while transporting a person seventeen years of age or younger.

          On a second or subsequent conviction of a violation of RCW 46.61.502 or 46.61.504 a person is subject to a mandatory minimum fine of one thousand dollars and a mandatory ten days of community service in a program benefiting children if the person committed the violation while transporting a person seventeen years of age or younger.

          The fines or mandatory service imposed under this section are not subject to suspension.
