Authorizing rents from leased beds of navigable waters in a code city not within a port district to be paid to the municipal authority.


          AN ACT Relating to leased beds of navigable waters in code cities outside of a port district; and amending RCW 79.92.110.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  RCW 79.92.110 and 1984 c 221 s 25 are each amended to read as follows:

          (1) Where any leased harbor area or tideland is situated within the limits of a town, whether or not the harbor area or tideland lies within a port district, the rents from such leases shall be paid by the state treasurer to the municipal authorities of the town to be expended for water-related improvements.

          (2) If any state-owned aquatic lands are situated within the limits of a code city not included in a port district and are not otherwise encumbered, the city may obtain a lease from the department of natural resources.  Seventy-five percent of the rental attributable to water-dependent uses and twenty-five percent of the rental attributable to nonwater-dependent uses from such leases shall be paid by the state treasurer to the municipal authorities of the code city to be expended for water-related improvements.  The portion of the rentals attributable to water-dependent uses retained by the state shall be deposited in the aquatic lands resource management cost account.

          (3) The state treasurer is hereby authorized and directed to make payments to the respective towns on the first days of July and January of each year, of all moneys payable under the terms of this section.
