Prohibiting hazing at institutions of higher education.


          AN ACT Relating to hazing at state and independent institutions of higher education; adding new sections to chapter 28B.10 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 28B.10 RCW to read as follows:

          As used in sections 2 and 3 of this act, "hazing" includes any method of initiation into a student organization or living group, or any pastime or amusement engaged in with respect to such an organization or living group that causes, or is likely to cause, bodily danger or physical harm to any student or other person attending a public or private institution of higher education or other postsecondary educational institution in this state.  The term "hazing" does not include customary athletic events or other similar contests or competitions.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 28B.10 RCW to read as follows:

          No student, or other person in attendance at any public or private institution of higher education, or any other postsecondary educational institution, may conspire to engage in hazing, participate in hazing, or commit an act that injures, degrades, or disgraces, or tends to injure, degrade, or disgrace any fellow student or person attending the institution.

          A violation of this section is a misdemeanor, punishable under RCW 9.92.030, by a fine of not more than one thousand dollars, or imprisonment in the county jail for not more than ninety days, or both.

 

          NEW SECTION.  Sec. 3.  A new section is added to chapter 28B.10 RCW to read as follows:

          A person who participates in the hazing of another, or any organization, association, or student living group that knowingly permits hazing to be conducted by its members or by others subject to its direction or control, shall forfeit any entitlement to public funds, scholarships, or awards and shall be deprived of any sanction, official recognition, or approval granted by a public institution of higher education.

          The public institutions of higher education shall adopt rules to implement this section.
