Establishing programs and information services about contraception.


          AN ACT Relating to Norplant; and adding new sections to chapter 74.09 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 74.09 RCW to read as follows:

          (1) The department of social and health services, in consultation with the office of family planning, shall develop and distribute educational materials regarding the Norplant contraceptive device to all medicaid providers planning to submit reimbursement for the insertion or removal of the device.  The educational materials must be equivalent in content to the materials made available to clients of the office of family planning.

          (2) The educational materials prepared under subsection (1) of this section must be prepared at an appropriate reading comprehension level and in languages other than English that will provide information to medicaid clients regarding at least all of the following:

          (a) Insertion and removal procedures;

          (b) The duration and effectiveness of the insert;

          (c) The estimated percentage of the insert's efficiency as a contraceptive device; and

          (d) Possible side effects, and the degree of seriousness of the side effects.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 74.09 RCW to read as follows:

          The department of social and health services, in consultation with the office of family planning, shall:

          (1) Establish a program to make available the Norplant contraceptive implant, or another functionally equivalent contraceptive that provides similar long-lasting pregnancy prevention that has been approved by the secretary for this program, to each female public assistance recipient who is able to become pregnant and who is receiving aid to families with dependent children.  Each of these public assistance recipients who has the Norplant contraceptive or other functionally equivalent contraceptive, implanted under this program is eligible to receive under this program a special financial assistance grant in the amount of five hundred dollars and a special annual financial assistance grant in the amount of fifty dollars during the period that the contraceptive remains implanted and continues to be effective in preventing pregnancy.  The program must provide for examinations by health care providers to provide for the health and safety of public assistance recipients who are to have the contraceptive implanted under the program;

          (2) Publicize the program established under this section among all public assistance recipients who are eligible to participate in the program;

          (3) Specifically provide information individually to each eligible public assistance recipient at least semiannually and to each eligible public assistance recipient who gives birth within thirty days after the birth; and

          (4) Adopt rules for the administration of the program established under this section, including appropriate requirements and procedures for examinations and consultations by public assistance recipients with health care providers to assure continued eligibility for grants under the program.
