AN ACT Relating to the authority of a public utility district to fluoridate water supply systems; and adding a new section to chapter 54.16 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1.  A new section is added to chapter 54.16 RCW to read as follows:

A public utility district by a majority vote of its commission may fluoridate the water supply system of the public utility district.  Alternatively, the commissioners may cause the proposition of fluoridation of the water supply to be submitted either to the electors of the public utility district and an advisory ballot to the persons who receive water service from the public utility district at any general election or special election to be called for the purpose of voting on the proposition and advisory ballot.  The proposition must be approved by a majority of the electors voting on the proposition to become effective.  This section only applies to a public utility district if the public utility district has sole control over the water and no dispute exists as to control over the water.
