Creating a civil penalty for committing a crime on or near premises licensed for consumption of liquor, payable to the owner of the establishment.


          AN ACT Relating to crimes committed on or near premises licensed for consumption of liquor; adding a new section to chapter 66.44 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 66.44 RCW to read as follows:

          (1) A person who causes bodily injury to another person either:  (a) On the premises of any establishment licensed under chapter 66.24 RCW for on-premises consumption of liquor; or (b) within fifty yards of any establishment licensed under chapter 66.24 RCW for on-premises consumption of liquor and the injured person was a patron of such establishment immediately prior to the injury, is liable to the owner of the establishment for a civil penalty of two hundred fifty dollars, damages to the premises, and loss of income to the business, plus attorneys' fees.  Such penalty is in addition to any other criminal or civil remedies provided by law.

          (2) For purposes of this section, "bodily injury" means physical pain or injury or an impairment of physical condition.
