Retiring older motor vehicles to reduce air pollution.


          AN ACT Relating to the early retirement of motor vehicles with high air contaminant emissions; adding a new section to chapter 70.120 RCW; and making an appropriation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.120 RCW to read as follows:

          The department shall establish a program to accelerate the retirement of older motor vehicles.  The program shall be designed to reduce air pollution and to provide lower cost air contaminant emission reduction opportunities for stationary sources of air pollution.

          The program shall apply to motor vehicles with the greatest potential for high air contaminant emissions.  The program shall be designed to ensure net air quality improvement.  The program shall be used to establish emission credits as authorized in RCW 70.94.850.  This section does not eliminate any requirement in chapter 70.94 RCW or this chapter, or any implementing rule adopted under chapter 70.94 RCW or this chapter.

          Vehicles affected by the program shall have their engines removed and scrapped, with remaining body and associated parts sent to automobile dismantlers for recycling.  If any such vehicle is reconstructed to an operational state, the vehicle shall not be relicensed until it passes a state emission inspection.  A reconstructed vehicle shall not be granted a waiver, as authorized in RCW 70.120.070, for failure to pass the inspection.

          The program shall be limited to vehicles registered in counties where state emission inspections are required.  To become eligible for the program during its first year, a vehicle shall have been registered for at least twelve consecutive months immediately before the initiation of the program.  To become eligible in the second year of the program and in each succeeding year, a vehicle shall have been registered for at least the previous twenty-four consecutive months.

          The department shall provide information and technical assistance related to the program to the public and owners or operators of potentially interested air pollution sources.  The department shall encourage such sources to take advantage of the program.

          By December 31, 1995, the department shall report to the appropriate standing committees of the legislature on the results of the program.  The report shall include but not be limited to discussion of level of interest, costs, air quality benefits and recommendations for changes.

 

          NEW SECTION.  Sec. 2.  The sum of . . . . . . . . . dollars, or as much thereof as may be necessary, is appropriated for the biennium ending June 30, 1995, from the air pollution control account to the department of ecology to develop and administer the program in section 1 of this act.  Direct costs of the purchase and recycling of vehicles affected by the program shall be determined by the marketplace and borne by those air pollution sources wishing to take advantage of the program in section 1 of this act.
