Making school construction and remodeling plans public property.

          AN ACT Relating to architectural plans for school construction; and adding a new section to chapter 28A.525 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 28A.525 RCW to read as follows:

          (1) Each contract entered into after the effective date of this section by a school district for the constructing or remodeling of a school shall contain a clause stating that the plans for the design or modification of a school or any modifications of those plans are public property and may be reproduced, modified, or used by the state or any school district in the state.

          (2) Each school district board of directors shall file the plans under subsection (1) of this section with the state board of education.  The state board of education shall maintain these plans and make them available to school districts throughout the state.

          (3) After January 1, 1999, a school district shall not be eligible for state matching funds for school construction unless the district uses a plan from the pool of plans or receives a waiver from using one of the plans from the state board of education.  The state board of education may waive this requirement if the district can demonstrate that it would not be cost-effective to use one of the plans on file with the state board of education.
