Allowing hazardous waste management permit exemptions for certain remedial action.

          AN ACT Relating to permit exemptions for certain remedial action; and adding a new section to chapter 70.105D RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 70.105D RCW to read as follows:

          A person conducting remedial action at a facility under a consent decree, settlement agreement, or order signed by the department, or a remedial action conducted by the department is exempt from state and local permit requirements that would otherwise apply to the remedial action, including those requirements imposed by chapters 43.21C, 70.94, 70.105, 90.03, 90.44, 90.48, 90.58, and 90.62 RCW.  The department shall ensure substantial compliance with the substantive provisions of otherwise applicable permit requirements through the consent decree, settlement agreement, or order.
