Allowing persons who filed late applications for early retirement to retire early anyway.


          AN ACT Relating to retirement eligibility for plan I members of the teachers' and public employees' retirement systems who submitted late applications for early retirement; creating new sections; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  (1) Any plan I member who meets the criteria in subsection (2) of this section may retire under chapter 234, Laws of 1992, by submitting a written retirement application to the department on the form supplied by the department.  In order to qualify for retirement under this section, the written retirement application must be submitted to the department or postmarked on or before July 1, 1993, for retirement effective no later than July 1, 1993.

          (2) This section applies only to members who:

          (a) Were otherwise eligible to retire under the terms and conditions of section 3, chapter 234, Laws of 1992;

          (b) Requested an estimate from the department on or before June 15, 1992, of the retirement benefits available to them under chapter 234, Laws of 1992;

          (c) Submitted notification to the department prior to August 31, 1992, of their intent to retire under the provisions of chapter 234, Laws of 1992; and

          (d) Were ineligible for retirement under chapter 234, Laws of 1992, due to a failure to submit a written application to the department on or before June 15, 1992.

 

          NEW SECTION.  Sec. 2.  (1) Any plan I member who meets the criteria in subsection (2) of this section may retire under chapter 234, Laws of 1992, by submitting a written retirement application on the form supplied by the department to the director.  In order to qualify for retirement under this section, the written retirement application must be submitted to the department or postmarked on or before July 1, 1993, for retirement effective no later than July 1, 1993.

          (2) This section applies only to members who:

          (a) Were otherwise eligible to retire under the terms and conditions of section 1, chapter 234, Laws of 1992;

          (b) Requested an estimate from the department on or before June 15, 1992, of the retirement benefits available to them under chapter 234, Laws of 1992;

          (c) Submitted written notification to the department prior to August 31, 1992, of their intent to retire under the provisions of chapter 234, Laws of 1992; and

          (d) Were ineligible for retirement under chapter 234, Laws of 1992, due to a failure to submit a written application to the department on or before June 15, 1992.

 

          NEW SECTION.  Sec. 3.  The effective retirement date for a member who elects to retire under section 1 of this act will be:

          (1) September 1, 1992, for members who separated from service on or before that date and did not subsequently render membership service to an employer; or

          (2) The first day of the month following the month in which the member terminated public school service, unless a full year of membership service is established for the 1992-1993 school year.  In that case the date of accrual of the member's retirement allowance shall be July 1, 1993.

 

          NEW SECTION.  Sec. 4.  The effective retirement date for a member who elects to retire under section 2 of this act will be:

          (1) September 1, 1992, for members who separated from service on or before that date and did not subsequently enter an eligible position; or

          (2) The first day of the month following the month in which the member separated from employment with an employer.

 

          NEW SECTION.  Sec. 5.  (1) Sections 1 and 3 of this act are each added to chapter 41.32 RCW, but because of their temporary nature, shall not be codified.

          (2) Sections 2 and 4 of this act are each added to chapter 41.40 RCW, but because of their temporary nature, shall not be codified.

 

          NEW SECTION.  Sec. 6.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
