Modifying provisions regarding shipping wine.



          AN ACT Relating to shipments of wine; amending RCW 66.12.120; adding a new section to chapter 66.12 RCW; and repealing RCW 66.12.190, 66.12.200, 66.12.210, and 66.12.220.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  RCW 66.12.120 and 1975 1st ex.s. c 173 s 3 are each amended to read as follows:

          (1) Notwithstanding any other provision of Title 66 RCW, a person twenty-one years of age or over may be authorized by the board to bring into the state of Washington from another state a reasonable amount of alcoholic beverages for personal or household use only upon payment of an equivalent markup and tax as would be applicable to the purchase of the same or similar liquor at retail from a state liquor store.  The board shall adopt appropriate ((regulations)) rules pursuant to chapter 34.05 RCW for the purpose of carrying into effect the provisions of this section.

          (2) Notwithstanding any other provision of Title 66 RCW, an individual or licensee in a state that affords Washington licensees or individuals an equal reciprocal shipping privilege may ship, for personal use and not for resale, not more than two cases of wine, with no more than nine liters each case, per year to a state resident age twenty-one or older.  Delivery of a shipment under this section may not be deemed to constitute a sale in this state.

          The shipping container of wine sent into or out of this state under this section shall be clearly labeled to indicate that the package cannot be delivered to a person under twenty-one years of age or to an intoxicated person.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 66.12 RCW to read as follows:

          A wine manufacturer, shipper, or person shipping wine under section 1 of this act and located outside this state may not, within this state, advertise for or solicit consumers to engage in interstate reciprocal wine shipment under section 1 of this act.

 

          NEW SECTION.  Sec. 3.  The following acts or parts of acts are each repealed:

          (1) RCW 66.12.190 and 1991 c 149 s 1;

          (2) RCW 66.12.200 and 1991 c 149 s 2;

          (3) RCW 66.12.210 and 1991 c 149 s 3; and

          (4) RCW 66.12.220 and 1991 c 149 s 4.
