Regulating ready-mix mixer trucks.



          AN ACT Relating to load regulations for ready-mix mixer trucks; adding a new section to chapter 46.44 RCW; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  The legislature finds that:

          (1) Washington is the only state among the thirty-three states recognizing the federal bridge axle formula to require the activation switch for a retractable axle on a ready-mix mixer truck to be located out of reach of the driver's compartment;

          (2) Retractable axles can only be operated in a fully up or fully down position and the variable control to adjust axle loadings is always located out of reach of the driver's compartment;

          (3) Modern safety standards require that the driver remain in the vehicle and operate the mixer from inside the driver's compartment whenever possible.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 46.44 RCW to read as follows:

          The department of transportation and local authorities may not adopt regulations requiring that a retractable axle up/down activation switch for a ready-mix mixer truck be located out of reach of the driver's compartment so long as any variable control used to adjust axle loadings by regulating air pressure or by other means is out of reach of the driver's compartment.
