Forbidding personal services contract benefits between agencies and state officials.



          AN ACT Relating to personal services contracts benefitting state officials; adding a new section to chapter 39.29 RCW; and adding a new section to chapter 42.20 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 39.29 RCW to read as follows:

          No agency shall enter into a personal services contract for the services of a person who is an elected or appointed state official.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 42.20 RCW to read as follows:

          (1) A person who is an elected or appointed state official may not be beneficially interested, directly or indirectly, in any personal services contract with any agency.

          (2) As used in this section:

          (a) "Agency" means all state agencies and all local agencies.  "State agency" includes every state office, department, division, bureau, board, commission, or other state agency.

          (b) "Local agency" includes every county, city, town, municipal corporation, quasi-municipal corporation, or special purpose district, or any office, department, division, bureau, board, commission, or agency thereof, or other local public agency.

          (c) "Personal services" means professional or technical expertise provided by a consultant to accomplish a specific study, project, task, or other work statement.

          (d) "Personal services contract" means an agreement, or any amendment thereto, with a consultant for the rendering of personal services to an agency.
