Modifying the powers of special facilities districts to buy and sell real property.



    AN ACT Relating to public facilities districts; and amending RCW 36.100.070.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 36.100.070 and 1988 ex.s. c 1 s 17 are each amended to read as follows:

    (1) A public facilities district may acquire and transfer real and personal property by lease, sublease, purchase, or sale.

    (2) A public facilities district shall not develop land for resale at a later date, in competition with private land developers.

    (3) A public facilities district shall, when selling or leasing real property, comply with the following requirements:

    (a) Identify the time and location where bid proposals will be accepted;

    (b) Identify the time and location of the sale of property;

    (c) Publish a notice of the information required in (a) and (b) of this subsection in a newspaper of general circulation in the county where the real property or part of the real property to be sold is located.  The notice shall be published at least once a week for three consecutive weeks prior to the sale; and

    (d) Sell or lease the real property for not less than the reasonable market value of the property, except with regard to land or easements granted for highway or public utility purposes.
