Setting out child support obligations for incarcerated parents.



    AN ACT Relating to child support obligations of an incarcerated parent; and adding a new section to chapter 26.19 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 26.19 RCW to read as follows:

    When establishing the child support obligation of a parent who is or will be incarcerated in prison or jail, the court shall calculate support following the procedures prescribed in this chapter, except that the incarcerated parent's lack of living expenses may constitute good cause for establishing a child support obligation that exceeds forty-five percent of the incarcerated parent's net income.  Further, the minimum support obligation for an incarcerated obligor shall be twenty-five dollars per month per child.
