HB 2379 - DIGEST

     Authorizes property owners to bring legal actions to obtain relief from an agency which acts in an arbitrary or unlawful manner in handling an application for a permit.

     Requires the owner to file a claim requesting damages with the agency prior to the assertion of a claim and requires the agency to act on the claim within ninety days.

     Provides that damages shall specifically include diminution in property value resulting from a violation of chapter 64.40 RCW by an agency.
