     On page 4, after line 8, insert the following:

     "NEW SECTION. Sec. 5.  This chapter shall not apply to:

     (1) The official distribution or use of material by a health care provider, or health agency under the supervision and control, or funded in whole or in part by the state, county, municipality, or other political division of the state;

     (2) Devices designed for contraceptive purposes; or

     (3) The depiction of a female breast-feeding an infant."

Renumber the remaining sections consecutively and correct internal references accordingly

EFFECT:  Exempts from the bill health care providers and health agencies under the control of the state or funded by the state, contraceptive devices, and depictions of breast-feeding.
